A. Instructions on withdrawal

Introduction

Consumers have a right of withdrawal on the following terms. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession:

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period expires fourteen days after the day on which you, or a third party designated by you other than the carrier, acquire physical possession of the last item of goods.

To exercise your right of withdrawal, you must inform us (Imke Hanscomb, TIZZ & TONIC, Hermann-Ritter-Straße 112, 28197 Bremen, Germany, Tel.: 01794536148, Email: hello@tizzandtonic.com) of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post or an email). You may use the attached model withdrawal form, but this is not obligatory.

You may also exercise your right of withdrawal online on the website at https://tizzandtonic.com/. If you use this online function, you will receive an acknowledgement of receipt on a durable medium (for example, by email) without delay, including information on the contents of your withdrawal declaration and the date and time it was received.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of your right of withdrawal before the withdrawal period expires.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for any additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days after the day on which we are informed of your decision to withdraw from this contract. We will make the reimbursement using the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.

You must send back the goods or hand them over to us without undue delay and in any event no later than fourteen days after the day on which you inform us of your withdrawal from this contract. The deadline is met if you send back the goods before the fourteen-day period expires.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or early expiry of the right of withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and whose manufacture is determined by an individual choice or decision by the consumer, or that are clearly personalised to the consumer’s needs.

The right of withdrawal expires early for contracts for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if they have been unsealed after delivery.

The right of withdrawal does not apply to consumers who, at the time the contract is concluded, are not nationals of a Member State of the European Union and whose sole residence and delivery address at that time are outside the European Union.

General information

1) Please avoid damaging or soiling the goods. Please return the goods to us in their original packaging, together with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please use suitable packaging to ensure adequate protection against damage in transit.

2) Please do not return the goods to us with postage unpaid.

3) Please note that compliance with points 1–2 above is not a prerequisite for validly exercising your right of withdrawal.
